Creator Terms

1Application of these Terms

These Terms of Service govern the agreement between the operator of Finger Creator, Sargia Inc. ("we", "us", or "our"), and creators ("Creator") who use Finger Creator (the "Service") to operate a creator business. Please read them carefully before applying. By completing your application to use the Service, you accept and agree to be bound by these Terms in full.

2Account Registration

To use the Service, Creators must submit an application through the method we provide. We issue an account after completing a review of the application.

You represent that the information you provide at registration is true and accurate, and you agree to keep it up to date. You are responsible for maintaining the confidentiality and security of your account. Unless caused by our negligence, we are not responsible for unauthorized use of your account.

3The Service

The Service is a software solution that provides Creators with features for managing their community, publishing content, engaging with fans, and administering monetization workflows.

We may add, change, or discontinue features of the Service within a reasonable scope.

4Prohibited Conduct

• Acts that violate laws or public order and morals
• Acts that infringe the intellectual property, publicity, privacy, or other rights of us or third parties
• Providing false information
• Interfering with the operation of the Service or engaging in unauthorized access
• Unauthorized operation of other users' or third parties' devices or systems
• Any other conduct we reasonably consider inappropriate

5Monetization and Payments

The Service provides management tools that support Creators in their monetization activities.

The conditions and method of revenue accrual, settlement, and payment will follow criteria we separately establish or a separate agreement concluded with the Creator.

Amounts and timing displayed in the Service are administrative reference information and do not guarantee confirmed revenue.

6Content

Unless otherwise agreed, Creators retain the rights to the content they post on the Service.

You grant us the right to use your content to the extent reasonably necessary to operate and provide the Service.

We may remove or restrict content that violates the law or infringes third-party rights.

7Disclaimer of Warranty and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. We do not warrant the accuracy, completeness, fitness for a particular purpose, or continuous availability of the Service.

To the fullest extent permitted by applicable law, we are not liable for damages arising out of or in connection with the use of the Service, except where caused by our willful misconduct or gross negligence.

Nothing in the Service constitutes investment advice, an offer or solicitation to trade financial products, or similar advice. You use the Service at your own judgment and risk.

8Termination

Creators may terminate this agreement at any time using the method we provide.

We may suspend or terminate the provision of the Service without prior notice if you violate these Terms or engage in conduct we reasonably consider inappropriate.

9Suspension of the Service

We may temporarily suspend all or part of the Service due to maintenance, system failure, force majeure, or other unavoidable causes. We are not liable for any damage arising from such suspension.

10Governing Law

These Terms are governed by and construed in accordance with the laws of Japan.

Any dispute arising out of or in connection with these Terms will be resolved in accordance with Japanese law.

11Changes to these Terms

We may update these Terms from time to time. When we do, we will notify you in advance by a method we consider appropriate, and the updated Terms take effect on the effective date stated in the notice.
